The Senate of the Oliy Majlis of the Republic of Uzbekistan as a supreme legislative
body of regional representation

The complex work of the Senate of the Oliy Majlis with local Kengashes of people’s deputies
and bodies of the executive branch of power

The Senate, as a newly established institutional body within the system of the state authority of the Republic of Uzbekistan, started to function as of January 2005 when a bicameral parliament was formed for the first time in the history of the state. The upper chamber was quickly formed and the senators have gained an experience necessary to achieve their objectives. Of course, certain problems arose at this stage. By analyzing the work donr, summarizing initial results, defining subsequent objectives and further ways of supporting constitutional regulation of the state mechanism as well as the sustainable development of the country, the President of the Republic of Uzbekistan, during the fifth plenary session of the Oliy Majlis, highlighted a strategic programme of perspective directions for the Senate, which includes the following:
- Making sure the national strategy is implemented all over the country;
- Making good use of constitutional powers to support comprehensive measures aimed at providing sustainable development of the country;
- Contribution to progressive innovations by conducting legislative and oversight functions of the parliament;
- Maintening direct contact with all regions of Uzbekistan and making sure there is feedback, encouraging interaction of members of the Senate with deputies of local Kengashes.
The Senate, as a representative body reflecting the wishes of all inhabitants of the different regions in Uzbekistan, is called upon to harmonize regional interests with nationwide ones, to bring society closer together by identifying regional problems in order to make the necessary decisions and actions based on strengthening the legislative basis.
A qualitative and effective realization of the abovementioned objectives can be achieved by means of an effective, regular and harmonious rhythm of co-operation of the central level of the legislative branch of power with the regional corps of deputies. The presence of an efficient mechanism of interaction, a logical structure of cooperation, finding an increasing number of solutions through direct contact and feedback will all contribute to achieving the main aim which is to improve citezens’ quality of life.
When establishing the business of the members of the Senate when it comes to their role in the regulation of socio-political, economic and regional legal aspects, and keeping in mind the nation-wide strategy, one should also remember that a large number of senators are also deputies of Kengashes of regions, cities and districts.
They have been nominated as deputy candidates and elected as senators in their joint sessions. They are, so to speak, plenipotentiaries of the local Kengashes in the supreme legislative body of the country; on the other hand, they represent the parliament at the local level that creates a basis for a close interrelationship.
Nevertheless, the upper chamber of the Oliy Majlis has taken specific and practical steps to maintain effective communication and constant interaction with the local Kengashes of people’s deputies and Djokarghi Kenes of the Republic of Karakalpakstan. They are as follows:
a) The Kengash of the Senate of the Oliy Majlis adopted a Action Programme to carry out the provisions of speeches of the President of the Republic of Uzbekistan delivered at the session of the Cabinet of Ministers on February 10, 2006 concerning the results of social and economic development of the country in 2005 and main points of the economic reforms in 2006, and during the fifth plenary session of the Senate of the Oliy Majlis on February 24, 2006 entitled «Strengthening the legislative basis of the country’s development - a basic criterion of our activity». This document states that joint meetings of the committees of the Senate and Djokarghi Kenes of the Republic of Karakalpakstan, including the Kengashes of people’s deputies of districts and the city of Tashkent are to be called. The Senate has also drawn up «Model Rules of local Kengashes of people’s deputies» and «Model Rules of standing commissions of local Kengashes of people’s deputies with a view to ensuringthe coordination of the Senate committees’ actions, those of the committees of Djokarghi Kenes of the Republic of Karakalpakstan as well as the standing commissions of the local Kengashes of people’s deputies when deciding on major issues of social and economic development of the regions».
b) From the wayof the way the Legislative Chamber deputies and of members of the Senate are elected, it is clear that the upper chamber, besides its legislative, oversight and foreign policy activities, is assigned with the important function of regional representation. This has required the close interaction of the Senate with regional, city and district representative bodies of government and the adoption of a resolution of the Kengash of the Senate ¹ 54-I dated July 21, 2005 «On the plans of thecommittees of the Senate of the Oliy Majlis of the Republic of Uzbekistan to implement certain aspects of the Programme of the Resolution of the President of the Republic of Uzbekistan ¹ PP-24 dated March 10, 2005 «On the Programme to acheivethe objectives of democratization and the renewal of society and reforming and modernizing the country», which contains, along with other important issues, measures aimed at maintaining an balance between nationwide and regional interests in the work of the Senate of the Oliy Majlis, improving an organizational legal mechanism of interaction between the Senate and local Kengashes.
c) Another programme document adopted in 2005, which laid the foundation for the creation of a mechanism of interaction of the upper chamber and representative bodies of local governments, was Complex measures for the improvement of organizational legal mechanisms of interaction between the Senate Oliy Majlis of the Republic Uzbekistan with the Djokarghi Kenes of the Republic of Karakalpakstan, the Kengashes of people’s deputies of regions and of the city of Tashkent, approved by a resolution of the Kengash of the Senate ¹ 92-I dated November 21, 2005.
d) With a view to supporting the interaction of committees and commissions of the Senate with Djokarghi Kenes of the Republic of Karakalpakstan, the local Kengashes of people’s deputies in conducting oversight activities, improving the coordination of actions with committees of Djokarghi Kenes of the Republic of Karakalpakstan, standing commissions of local Kengashes of people’s deputies in dealing with the major issues of social and economic development of regions, Model Rules of local Kengashes of people’s deputies and Model Rules of standing commissions of local Kengashes of people’s deputies as well as «Recommendations on organization of business of local Kengashes of people’s deputies» were approved by a resolution of the Kengash of the Senate ¹173-I dated June 8, 2006.
e) Taking into account a need to further improve a legal basis regulating the business of local Kengashes of people’s deputies and their structures, as well as to update the rules and regulations of standing commissions of local Kengashes of people’s deputies, the abovementioned Model Rules and Model Rules of standing commissions and also Recommendations on organization of business of local Kengashes of people’s deputies were approved in a newly worded form by a resolution of the Kengash of the Senate ¹305-I dated March 9, 2007.
f) With a view of implementing measures aimed at maintaining a balance between nationwide and regional interests in the business of the Senate of the Oliy Majlis, the Kengash of the Senate passed a resolution ¹ 200- I dated June 29, 2006, specifying ways in which committees of the upper chamber can interact with standing commissions of local Kengashes of people’s deputies and bodies of executive authorities, namely: to include representatives of standing commissions of local Kengashes and bodies of executive authorities in working groups to be formed by committees of the Senate; to consider the results of the study of implementation of laws of the Republic Uzbekistan, resolutions of the Senate and resolutions of its committees at joint sessions held with local Kengashes of people’s deputies; put together recommendations to improvethe way the local Kengashes of people’s deputies go about their; to inform the local Kengashes of issues considered during plenary sessions of the Senate. Work in this area is still in progress.
g) On January 26, 2007 the Kengash of the Senate passed a Resolution ¹294-I «On the performance of the Resolution of the Kengash of the Senate of the Oliy Majlis of the Republic Uzbekistan «On interaction of the Senate of the Oliy Majlis of the Republic Uzbekistan with local Kengashes of people’s deputies and bodies of executive authorities to ensure implementation of laws of the Republic Uzbekistan, resolutions of the Senate and Senatecommittees», which summed up the results of the local Kengashes’ activities and its standing commissions for 2006, and made recommendations for further improvement.
All the abovementioned documents have created a basis for organizational and legal support of interaction among bodies of the representative authority at all levels, have facilitatedthe set-up of a mechanism of coordination of their business ses and further defined the activity of the Kengash and committees of the Senate.
